Terms and Conditions of Sale
SWIMMING WITH MARINE ANIMALS / DOLPHINS
- BOOKING AND VALIDITY OF SERVICES
Registrations and bookings made with SAS DTO are valid for two seasons: the current season and the following season, subject to the conditions set out below.
Registrations may be made throughout the year for the upcoming season.
Any booking is considered firm and final once full payment for the service has been received. Payment arrangements may nevertheless be granted upon request and subject to prior approval by SAS DTO.
Bookings may be made:
- for a specific outing date;
- or in the form of an “open ticket”, allowing the customer to choose the date of the service at a later stage, subject to availability.
Holders of an open ticket must request a booking date by telephone or email after checking the available schedule.
An appointment date is considered definitively confirmed only once a confirmation email has been received from SAS DTO.
We also recommend that customers check their junk mail or spam folders.
- METHODS OF PAYMENT
We accept the following methods of payment:
- online payment;
- bank transfer;
- cheque sent by post;
- bank card;
- payment via a payment link sent by email;
- cash, at the office only, no more than a few days before the outing.
Online payment
We recommend online payment, which allows customers to book directly through our website, either for a specific date or in the form of an open ticket.
As the schedule may change quickly, booking online makes it easier to secure an available place.
Payment by cheque
Cheques must be made payable to SAS DTO and sent by post together with the fully completed registration form.
The postal address is indicated on the registration form.
Please do not send payments by registered post with acknowledgement of receipt. Tracked mail may be used if desired.
Cheques are no longer accepted directly on site and must be deposited and processed at least 10 days before the outing.
Payment by bank transfer
The fully completed registration form and proof of bank transfer must be sent to us by email.
Payment via payment link
Payment by bank card may be made on site or via a payment link sent by email.
Cash payment
Cash payments are accepted at the office only.
- CANCELLATION OR MODIFICATION AT THE CUSTOMER’S REQUEST
Any confirmed booking constitutes a firm commitment.
Booked and paid services are non-refundable in the event of cancellation or withdrawal by the customer.
However, we wish to provide solutions allowing our customers to retain the benefit of their booking in the event of unforeseen circumstances.
Requests made at least 15 days before the outing
Any request for modification or cancellation must reach us at least 15 calendar days before the scheduled outing date.
When this deadline is met, the customer may, subject to availability:
- request that the service be rescheduled to a new date;
- retain the ticket and select another date during its validity period;
- or transfer their place to another person of their choice, provided SAS DTO is informed so that the name on the booking can be amended.
Less than 15 days before the scheduled date, no request for rescheduling or change of date initiated by the customer can be accepted, except in the exceptional circumstances described below.
Rescheduling or transferring the service does not entitle the customer to a refund.
A confirmed date may be changed free of charge up to a maximum of two date changes. Beyond this limit, an administration fee of €15 will be charged for each additional modification.
Requests made less than 15 days before the outing
Less than 15 days before the scheduled date, no request for cancellation, rescheduling or change of date initiated by the customer can be accepted.
The full price of the service will remain due and all amounts already paid will be retained.
To avoid losing their place entirely, the customer may nevertheless transfer their booking to another person, provided SAS DTO is informed before the outing and the replacement participant meets any conditions required to take part in the activity.
Any request for cancellation, rescheduling, change of date or transfer must be submitted by email or by post.
Requests made solely by SMS, voicemail or instant messaging will not be considered official requests for modification.
- WEATHER, SEA CONDITIONS AND TECHNICAL ISSUES
The safety of our participants and teams remains our highest priority.
As the activities offered by SAS DTO are directly dependent on weather conditions, sea conditions and the technical conditions required for the proper operation of the outings, a service may exceptionally have to be rescheduled, including at very short notice.
We generally make our decision after reviewing the latest available weather forecasts and contact participants on the morning of the day before the outing, mainly by telephone call or SMS.
This decision is made exclusively by SAS DTO and the persons responsible for the activity, who have sole discretion to determine whether conditions allow the outing to take place safely and satisfactorily.
In the event of rescheduling by SAS DTO due to weather conditions
When weather conditions, sea conditions, a technical issue or any other safety-related circumstance prevent the service from taking place on the scheduled date, the outing will be rescheduled to a new date.
The ticket and all amounts paid remain valid for the service originally purchased.
A new date will be proposed or selected together with the customer according to:
- the availability of SAS DTO;
- the availability of the participant.
Where possible, a new outing may, in particular, be arranged for the following day or during the following days.
The mere rescheduling of an outing due to weather, sea conditions, safety reasons or a temporary technical issue does not entitle the customer to a refund, subject to any mandatory legal provisions that may apply.
If the participant is unable to return on the newly proposed date, the ticket remains valid during its validity period and another date may be arranged jointly.
The participant may also transfer the ticket to another person, provided we are informed beforehand so that the booking details can be amended.
Our objective is to enable every customer to enjoy the service they have booked under the best possible conditions, while always giving absolute priority to safety.
We understand that serious unforeseen circumstances can unfortunately arise at any time.
Accordingly, even where an event occurs less than 15 days before the scheduled outing date, SAS DTO may exceptionally allow the service to be rescheduled where the participant is unable to attend due to a serious, sudden event beyond their control.
Such situations may include:
- an accident;
- hospitalisation or a serious medical condition preventing participation;
- the death of a close relative;
- a road traffic accident preventing travel to the meeting point;
- or any other exceptional situation of a comparable nature.
Supporting documentation may be requested in order to process the request.
In such circumstances, the service will not be refunded, but the amount paid will not be lost. The booking will be converted into a ticket to be rescheduled, allowing the participant to choose a new date with SAS DTO, subject to availability and within the applicable validity period of the ticket.
If the participant does not wish or is unable to take part in the service at a later date, they may also transfer their ticket to another person of their choice, provided SAS DTO is informed so that the booking can be amended.
This possibility constitutes an exceptional commercial arrangement intended to allow customers facing genuine unforeseen circumstances to retain the benefit of their booking. It does not entitle the customer to any cash, bank card, cheque or bank transfer refund.
- TRAVEL, ACCOMMODATION AND TRANSPORT COSTS
Given the nature of our activities and their dependence on weather and sea conditions, we strongly recommend that customers travelling from a distance choose, wherever possible:
- train or plane tickets that can be changed or refunded;
- accommodation with flexible cancellation conditions;
- travel arrangements allowing a degree of flexibility around the scheduled date.
To the extent permitted by applicable regulations, SAS DTO cannot be held liable for additional expenses incurred by the participant with third-party service providers, including transport, accommodation, meals or other personal expenses, in the event that the outing is rescheduled.
Whenever possible, we recommend allowing two to three days of flexibility around the selected date.
We naturally make every effort to operate each outing on the date originally scheduled.
- NUMBER OF PARTICIPANTS AND ORGANISATION OF OUTINGS
Certain outings may require a minimum number of participants or specific organisational conditions.
Where these conditions are not met, SAS DTO may propose rescheduling the service to a new date.
The ticket will remain valid and may be used for a future outing in accordance with these General Terms and Conditions of Sale.
- OPEN TICKETS AND RESCHEDULING
Open tickets allow the holder to select a date at a later stage from the dates available with SAS DTO.
They do not guarantee availability on any particular date until that date has been confirmed in writing by SAS DTO.
It is therefore the responsibility of the ticket holder to contact us sufficiently in advance to select a date.
Tickets that have been rescheduled retain their value for the service originally booked throughout their validity period.
They may also be transferred to a third party after prior notification to SAS DTO.
- FAILURE TO ATTEND ON THE DAY OF THE OUTING
If a participant fails to attend on the day of the outing without a modification having been accepted beforehand in accordance with these General Terms and Conditions of Sale, this will be considered a withdrawal.
The service will be considered due and used, and no refund or rescheduling will be granted.
- ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS OF SALE
Confirmation of a booking and payment for the service imply that the customer acknowledges having read and accepted these General Terms and Conditions of Sale without reservation.
The customer acknowledges in particular having been informed of:
- the booking conditions;
- the validity period of the ticket;
- the rules relating to changes of date;
- the conditions applicable in the event of withdrawal;
- the possibility of transferring their place;
- and the possibility that an outing may be rescheduled due, in particular, to weather, sea, technical or safety conditions.
These provisions apply subject to any mandatory legal rights and protections available to consumers which cannot lawfully be waived by contract.
